These Terms & Conditions govern your use of Lagos Market, operated by NextGen Limited. They apply to all buyers, sellers, and visitors of the platform.
1. Acceptance of terms
By creating an account, listing an item, contacting a seller, or making a purchase on Lagos Market, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the platform.
2. Who can use Lagos Market
You must be at least 18 years old and able to form a legally binding contract to buy or sell on Lagos Market. By registering, you confirm that the information you provide (including your name, phone number, and location) is accurate.
3. Listings
Listing items on Lagos Market is free. Each account may have up to 10 live listings (active or awaiting review) at a time; sellers can pause, delete, or mark a listing as sold to free up space. Sellers are responsible for the accuracy of their listings, including item condition, price, and photos. Listings must comply with Nigerian law, counterfeit goods, stolen items, weapons, and other prohibited items may not be listed. Lagos Market reserves the right to remove any listing or suspend any account that violates these rules, and listings go through an approval step before they appear publicly.
4. Ways to buy
Buyers can either (a) contact the seller through Lagos Market chat or by phone and arrange payment and handover directly with the seller (a "direct transaction"), or (b) pay through Lagos Market using Protected Purchase. The buyer chooses which option to use for each purchase.
5. Direct transactions
A direct transaction is an agreement solely between the buyer and the seller. Lagos Market is not a party to it, does not receive or hold the payment, and is not responsible for the item's condition, delivery, payment, or any refund. The buyer protection, dispute resolution, and payout terms below apply only to Protected Purchase orders. We strongly recommend following the safety tips published on the platform and inspecting items before paying.
6. Protected Purchase
Payments made using Protected Purchase are processed via Paystack and settled through NextGen Limited's Paystack merchant account. NextGen Limited, as the operator of Lagos Market, holds and releases these funds, they are not held by individual buyers, sellers, or any third party. Funds are released to the seller once the buyer confirms receipt of the item, or automatically after the 48-hour inspection window closes without a dispute being raised. Buyers pay the listed price with no additional fee for using Protected Purchase; a commission is deducted from the seller's payout at the rate applicable to the item's category. 7. Disputes
If an item bought with Protected Purchase does not match its listing, the buyer may raise a dispute within the inspection window. Lagos Market will review the dispute and may refund the buyer or release funds to the seller based on the evidence provided. Our decision on disputes is final. When and how refunds are issued is set out in our Marketplace Policies. Lagos Market does not resolve disputes about direct transactions, but users may report suspicious listings or accounts to support.
8. Seller payouts
For Protected Purchase orders, sellers must add a verified Nigerian bank account before payouts can be released. Payouts are issued directly by NextGen Limited to the seller's verified bank account. Lagos Market is not responsible for delays caused by incorrect or unverified payout details.
9. Contact details and messages
Sellers who add a phone number to their account agree that it may be shown to signed-in users who choose to call them about a listing. Contact details and messages obtained through Lagos Market may only be used to discuss the relevant listing or transaction.
10. Prohibited conduct
You may not use Lagos Market to commit fraud, harass other users, post misleading listings, send spam or unsolicited promotions through chat or phone, misuse other users' contact details, or otherwise abuse the service. Violations may result in account suspension or termination.
11. Limitation of liability
Lagos Market provides a platform for buyers and sellers to find each other and transact, and is not a party to the underlying sale. To the fullest extent permitted by law, Lagos Market is not liable for losses arising from direct transactions, or for indirect, incidental, or consequential damages arising from your use of the platform.
12. Changes to these terms
We may update these Terms & Conditions from time to time. Continued use of Lagos Market after changes are posted constitutes acceptance of the updated terms.
